Op 11 juni heeft het Europees Hof van Justitie uitspraak gedaan in de zaak van Ilse van Kuilenburg, advocaat bij Gelijk Advocaten. Een uitspraak met grote gevolgen voor de toetsing van opvolgende asielaanvragen en misschien nog wel breder, voor eerste aanvragen. Tot deze uitspraak stelde de IND zich op het standpunt dat alleen originele documenten waarvan de authenticiteit kan worden vastgesteld als nieuwe feiten of omstandigheden kunnen worden aangemerkt. In alle andere gevallen kon de opvolgende aanvraag niet ontvankelijk worden verklaard. Met deze uitspraak van het Europees Hof van Justitie is daar een einde aan gekomen. Het Hof overweegt dat een document waarvan de authenticiteit niet kan worden vastgesteld of de bron niet objectief verifieerbaar is niet automatisch gepasseerd kan worden als nieuw feit. Verder overweegt het Europees Hof dat de samenwerkingsverplichting die geldt in eerste asielaanvragen ook dient te gelden in opvolgende asielaanvragen. Hiermee wordt recht gedaan aan de bijzondere positie waar asielzoekers in verkeren. Het is nu eenmaal niet altijd mogelijk om alles te onderbouwen met officiële documenten. De rechtbank Den Bosch zal naar aanleiding van deze uitspraak nog een beslissing moeten nemen in de zaak.
